KAPUSKASING – On December 16, 2018, at approximately 2:45 a.m., members of the James Bay Detachments of the Ontario Provincial Police (OPP), responded to a traffic complaint in the Village of Val Rita, Ontario.

Police located the erratic driver and determined that he was impaired by drug. He subsequently failed the testing administered by a Drug Recognition Expert (DRE).

Sebastien Lemieux, 20-years-old, of Kapuskasing, Ontario, has been charged with the following offences:

  • Driving While Ability Impaired – Drug contrary to section 253(1)(a) of the Criminal Code of Canada (CC), and
  • Possession of a Schedule I Substance – Cocaine contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA).

He is scheduled to appear at the Ontario Court of Justice in Kapuskasing, Ontario, on January 28, 2019.

On December 16, 2018, at approximately 10:15 p.m., members of the James Bay Detachments of the Ontario Provincial Police (OPP), responded to a motor vehicle collision on Front Street in the Town of Hearst, Ontario. The Commercial Motor Vehicle (CMV) driver struck a light pole then failed to remain at the scene.

The male driver was located at a local gas station and police determined that he had consumed alcohol.

Sakilahmed Chhalawala, 53-years-old, of Scarborough, Ontario has been charged with the following offences:

  • Care or Control While Impaired – Alcohol contrary to section 253(1)(a) CC,
  • Care or Control Over 80 milligrams contrary to section 253(1)(b) CC,
  • Fail to Remain contrary to section 200(1)a) of the Highway Traffic Act (HTA),
  • Fail to Maintain Daily Log contrary to section 190(3) HTA,
  • Enter Inaccurate or False Information in Daily Log contrary to section 27(1) of Ontario Regulation 555/06 HTA,
  • Fail to Carry Inspection Schedule contrary to section 107(6) HTA, and
  • Smoke Tobacco in Prohibited Place contrary 12(1) of the Smoke-Free Ontario Act.

He is scheduled to appear at the Ontario Court of Justice in Hearst, Ontario, on January 28, 2019.

Both drivers were served with a 90 day Administrative Driver’s Licence Suspension (ADLS) and the motor vehicles were impounded for seven days.

The OPP reminds the motoring public to drive responsibly during this festive season.

Police are also asking the public to call the authorities if they see someone getting behind the wheel after having consumed intoxicating substances.
